Heroes at Home Wish Registry extended until October 31st - Hoffman Estates IL - Sears Program for our Military

Heroes at Home Wish RegistryI recently wrote a post regarding giving Sears special attention when it comes to Christmas Shopping this year because of all the great work they are doing for our men and ladies in the Military.

HOFFMAN ESTATES, Ill., Oct. 24 /PRNewswire/ -- As part of its unwavering commitment to the men, women and families of the U.S. armed forces, Sears Holdings Corporation is pleased to extend the deadline of the Heroes at HomeWish Registry(sm) to Friday, October 31 and encourages all active military personnel to apply. In consultation with the U.S. Department of Defense, Sears is pleased to extend the popular program that enables America to fulfillwishes for up to 20,000 deserving military families and personnel this holiday season. Through this offering, Sears is continuing its long-standing tradition of support of the military whose sacrifices deserve much recognition.

Schaumburg IL Market ConditionsYou know what makes me crazy?  Market graphs that don't tell you what is really going on in the real estate market.  Let me tell you what I've noticed from the local media and alot of my own real estate compadres recently - graphs that point to the past!  Yes we are down from 2006 and 2007 but do you really care if you have to sell your home now?  I am thinking you are reading this post because you want to sell your house NOW - TODAY - OR SOON!

BUT CAN YOU?  WHAT CAN YOU EXPECT?  So I've decided to talk about what has happened RECENTLY, in the last 6 months of the market.  That is the best 'current time' that I can do.  No sense talking about the past or what market increases you are not experiencing NOW.

Remember that old song by the Grass Roots?  Sha-la-la-la-la-la live for today! 

This graph represents all the single family homes for sale in Schaumburg at the current time.  What the graph depicts is a steady decline in homes on the market since the 2nd week of August.  Currently there are 17% less homes on the market since the beginning of May 2008.

That is good, in order for the market to correct itself and prices to stabilize we need less homes on the market.  For September 2008 - 12 months supply of homes on the market.  In a 'good' market there is an average of around 6 months supply.  So obviously we have twice that amount over a healthy market place in times past.

Are people taking their homes off the market with the holidays approaching?  YES

Are people renting their homes instead of selling them if they can afford it?   YES

Should people take their home off the market if they don't have to sell it?   YES - PROBABLY - I bet you didn't expect me to say that!

Schaumburg IL Market conditionsAre people making bad financial decisions regarding their home because they are scared of current market conditions on Wall Street?   YES

Is it a good time to buy a home?   YES - there is alot of 'good' houses at great prices. 

Are there alot of 'deals' to be had?   YES - so get going and get one.  Please call me so we can get started today!

Are there alot of foreclosures in the area?   YES and NO - The media has definitely brought your attention to the situation hasn't it?  There are only a small percentage of homes in Illinois currently in default, 95% of people are not in foreclosure according to statistics.

Sears - Christmas Gifts and our Military Personnel - Lyn Sims (847)230-7324 RE/MAX Suburban

Sears - Christmas shopping this year. 

I know I needed this reminder, since Sears isn't always my first choice. It's amazing when you think of Military Personnelhow long the war has lasted and Sears hasn't withdrawn from their commitment. Could we each buy at least one thing at Sears this year?

How does Sears treat its employees who are called up for military duty? By law, they are required to hold their jobs open and available, but nothing more. Usually, people take a big pay cut and lose benefits as a result of being called up for active duty.

Sears is voluntarily paying the difference in salaries and maintaining all benefits, including medical insurance and bonus programs, for all called up reservist employees for up to two years.

I submit that Sears is an exemplary corporate citizen and should be recognized for its contribution. I suggest we all shop at Sears at least once, and be sure to find a manager to tell them why we are there so the company gets the positive reinforcement & feedback it well deserves.

Pass it on.  I decided to check this before I sent it forward. So I sent the following e-mail to the Sears Customer Service Department:

I received this e-mail and I would like to know if it is true. If it is, the internet may have just become one very good source of advertisement for your company. I know I would go out of my way to buy products from Sears instead of another store for a like item, even if it's cheaper at that store.

This is their answer to my e-mail:

Dear Customer:

Thank you for contacting Sears.The information is factual.  We appreciate your positive feedback.

Tax Appeal Process - Cook County IL - Schaumburg Township - Schaumburg Illinois

Was helping a new purchaser finish up with a few loose ends regarding his new home purchase in Hoffman Estates.  
Big problem - his taxes.  Don't quite know what the previous owner did but it's a costly mistake.  An absolute blunder!  Taxes on this house are now $5809.07 for 2007.  Before you say - well too bad this rich guy deserves those taxes - think again!  Let me tell you that this is great ranch house in a 'regular Joe' subdivision in Hoffman Estates with 3BR 2 BA's, Familyroom addition with fireplace, 2 car garage, regular sized lot.  The amazing thing is when you delve further into similar homes the injustice and inconsistencies with Cook County just kicks you right in the head!

So let's look at the comparable properties that I used all in the same subdivision:

#1        3 blocks away from subject - Ranch, 3BR 1.5BA, Familyroom addition, Fireplace, 2 Car Detached Garage.  Taxes for 2007 = $3504.18          -2304.89

#2        6 blocks away from subject - Ranch 3BR 1BA, Familyroom addition, Fireplace, 2 Car Detached Garage    Taxes for 2007 = $3754.23          -2054.84

#3        5 blocks away from subject  Ranch 3BR 1BA, Familyroom addition, Fireplace, 2 Car Detached    Taxes for 2007 = $4287.56         -1521.51

#4        3 blocks away from subject - Ranch 3BR 2BA, Familyroom addition, NO Fireplace, 3 Car Detached   Taxes for 2007 = $3245.31           -2563.76

So it's an easy choice, a 'no brainer' if you will.   The new owner is going to file an appeal with either the Cook County Board of Review or with the Cook County Assessor.Tax appeal  Either way, it's a good bet that you should file an appeal because you should only pay your due portion and absolutely nothing more!  The variances of tax amounts is what I am trying to point out to you in this post.  Virtually the same house, plus or minus 40 sq feet or so and the tax range can be huge if you don't do anything about it.  

I wanted to quote a message from John Lawson at the Schaumburg Tax Assessors Office  from the Town Crier Bulletin:
 
"For residents who appealed their property taxes this year, the Board of Review reduced assessments 87% of the time, while the Cook County Assessor's Office only reduced assessments 11.25% of the time".   SO MY SUGGESTION IS TO GO BEFORE THE BOARD OF REVIEW simply because they seem to be more lenient.

"Schaumburg Township residents can appeal their assessment in late fall of 2008.  Go to the Cook County Website to keep posted on the estimated date for filing an appeal.  Once the Cook County Assessor opens for appeals, there will only be 30 days for appeal.  If you file an appeal and it is successful, it will be applied to your 2008 tax bill, payable in 2009."

Other ways to be sure your taxes are as low as possible - Senior Exemptions!  If you were born in 1943 or before, you are entitled to the senior exemptions.  There are three exemptions that seniors may be eligible for:  Homeowners Exemption, Senior Exemption and Senior Freeze.  

Exemptions are deductions applied to your real estate tax bill, if you qualify.  The exemptions are only applied ON THE SECOND INSTALLMENT of your property taxes every year.  If you qualify and the exemptions were not applied, you can file a 'CERTIFICATE OF ERROR' to correct this error at the Schaumburg Township Assessors Office; Rolling Meadows Assessor's Office; or the Chicago Assessor's Office.

In recap, we are filing on two different grounds:  Uniformity Appeal - the assessed valuation of your home is not in line with the assessed valuations of other homes, comparing your property to similar homes.  Overevaluation Appeal - appeal if you believe the estimate of the property value is overvalued for any reason.



So this post will be marked  'to be continued'.  But this gives you some guidelines and suggestions should you decide to appeal your taxes with Cook County.

Lake County IL Real Estate Tax Protest

This is another post from a tax protest in Barrington which is also in Lake County.  Basically states that the appeal must be used until the next quadrenial assessment.

These guys are tricky if you let them get away with it.  Only be sure to pay your fair share!

I recently received notice of a 21% increase in my Lake County IL 2008 real estate tax assessed valuation.  In 2007, I along with many of my neighbors, were facing a similar increase and protested to the Lake County Board of Review.  They agreed with our position and rolled back the 2007 increase.  Now, with a year to do their homework and modify their mechanics, the assessor's office found a way to increase the assessment again.  This time, we have the ability to protest in another way and that is "MATTER OF LAW".  The following is the meat of our protest and I thought some of you might appreciate the sections that are copied below.  Wish us luck!

The Lake County Board of Review rules for 2008 set forth a set of "reasonable rules for the guidance of persons doing business with the Board and for the orderly dispatch of business."  The rules include an Appeals Based upon Matters of Law, which states:

 "Prior Board of Review Decisions.  Owner occupied residential property assessment appeals based up on prior year Board of Review decisions should contain the Notice of Finding from the Board of Review from the general assessment year or from the subsequent year where applicable.  Aside from substantial cause, prior year decisions on owner-occupied residential properties should be carried forward until the next general assessment year, subject to the Chief County Assessment Officer's equalization.  Cases based solely on this reason will be set for review only after a review by the Board or its staff."[i]

 Furthermore, Illinois Property Tax Code Article 16 Division 2 Section 16-80 "Reduced assessment of homestead property." states:

 

"Sec. 16-80. Reduced assessment of homestead property.

In any county with fewer than 3,000,000 inhabitants, if the board of review lowers the assessment of a particular parcel on which a residence occupied by the owner is situated, the reduced assessment, subject to equalization, shall remain in effect for the remainder of the general assessment period as provided in Sections 9-215 through 9-225, unless the taxpayer, county assessor, or other interested party can show substantial cause why the reduced assessment should not remain in effect, or unless the decision of the board is reversed or modified upon review. (Source: P.A. 88-455; 89-126, eff. 7-11-95; 89-671, eff. 8-14-96.)."

SO WHAT'S UP WITH THE REAL ESTATE MARKET?

Interested in getting a copy of the best overall market information and real estate sales conditions that I could find recently?  It’s an article from Chicago Magazine’s October Issue "What's your House Worth" that just came out and offers extensive data on each town and neighborhood in the Chicagoland area.   What makes this article important is that it is compiled from the local MLS (MRED) not some of these other hallucinating websites like zillow, yahoo real estate, etc. where they never seem to actually know where their numbers come from.  Accuracy is important to me, it should also be important to you regarding your largest investment - your home.

You're probably curious about what is going on in the area marketplace regarding your homes value or you wouldn't be here.  The ‘talking heads’ tell you everyday the doom and gloom of either the mortgage crisis or another corporate meltdown taking place.   I think when you read the article you will be pleased that your homes value hasn’t tanked butSchaumburg Illinois real estate there is a definite glut of homes on the market for sale. 

Prices do not increase when competition to sell is a fierce as it is.  Here are some examples of the 'absorption rates' for our area.  This is fancy sales speak for 'Hey - how many homes are on the market and how long with it take to sell on the average'.  A 'good market' is normally in the 5-6 month range.  (This is what Realtors go to church on Sunday and pray for!)

Schaumburg -  9.9 months supply, highest was in 12/2007 at 32.3 months.

Hoffman Estates -   11 months supply, highest was in 12/2007 at 15.5 months.

Elk Grove Village -  12.1 months supply, highest was in 12/2007 at 23.2 months.

Bartlett -   9.8 months supply, highest was in 12/2007 at 22.8 months.

Roselle -  15.6 months supply, highest was in 3/2007 at 26.2 months.

Bloomingdale -  15.1 months supply, down from highest of all in 1/2008 of 86 months.

Streamwood -  11.9 months supply, highest was in 2/2008 of 20.6 months.

Hanover Park -  10.2 months supply, highest was in 10/2007 of 20.8 months.

Elgin -  14.5 months supply, highest was in 12/2007 at 27.6 months.

South Elgin -  10.5 months supply, highest was in 12/2007 at 24.8 months.

Itasca -  13.4 months supply, highest was in 6/2008 at 79 months.  

Carol Stream -  9.3 months supply, highest was in 11/2007 at 21 months.

St. Charles -  14 months supply, highest was in 1/2008 at 28.9 months.

Now is a Smart Time to Buy!  Here's what's Available by Price Range in Hoffman Estates and Schaumburg!


Now is a great time to buy a home, say the financial gurus at the Wall Street Journal, so GET OFF THAT FENCE!Schaumburg IL,Hoffman Estates IL,   (Not to mention is just huuuurtsssssssss your keester after awhile!)

The Journal calls it a buyers market and offers these suggestions for first-timers getting their feet wet. While their advice is solid, it's not revolutionary, but some potential customers might find it reassuring.

 


Remember this is a place to live not a stock market investment, they say. Lenders want buyers to spend no more than 28 percent of their gross monthly income on mortgage payments, real estate taxes, and home insurance. Buyers shouldn't count on stretching further because lenders won't approve their loans.

  • Cash is king.  Having enough money in the bank to pay closing costs that are typically an additional 2 percent to 3 percent of the price of the home is necessary.
  • Location, Location, Location.  As any good real estate professional knows, homes in good school districts where the crime is low are much more likely to hold or increase their value.
  • Compare.   Besides just looking at the comps(houses that sold), buyers should examine what it would cost to rent a similar house in the same area and they might consider what it would cost to buy land and build a comparable home.
  • Think long haul.  It will probably take at least six or seven years of living in the house to be able to sell and come out ahead.

home selling advice,selling advice,seller closing costs,Home Seller Closing Costs – there are more closing costs in the average real estate transaction than just the Realtors commission!  Here are a few examples of standard closing costs in our area.


Survey - Sellers in Illinois are responsible for giving the prospective buyer a plat of survey of the property. The price for a plat of survey can range from $150 to $600.  In our area it cannot be older than 6 months.

Recorded release of mortgage - Verifies that your mortgage has been completely paid off by the sale proceeds, usually $20 to $150.

Courier fee to pay off loan - Typically runs $50 to $100 or more.

Title insurance - The seller must provide a policy of title insurance for the buyer. The cost of the policy depends on the sales price of the home and its cost can vary from a couple hundred dollars to several thousand dollars. Some title companies have added additional charges to the basis title charge. These fees go by the name of “update fees,” “policy issuance fee” and the like. Some fees are as low as a couple of dollars and others up to $100.   (Examples would be $200,000 is $1075 - $300,000 is $1275. - $400,000 is $1475. - $500,000 is $1675.)

Local city, town or village property transfer tax; county transfer tax, state transfer tax - The tax man cometh, and it could cost you, although the charges vary from municipality to municipality. In Illinois, the seller picks up the county tax ($.50 per $1,000 of sales price) and the state tax ($1 per $1,000 of sales price).

In most local municipalities, the seller also pays for a local transfer tax. In general, property transfer taxes can range from nothing to $10 per $1,000 of the sales price or more, or you may be assessed a flat fee.  Examples below.

Elgin – nothing.  There’s nothing better than zero and unfortunately it's rare.
Elk Grove Village - $3 per $1,000 of sales price.
Hoffman Estates - $3 per $1,000 of sales price.
Schaumburg - $1 per $1,000 of sales price.  If you are also moving from one village location to another this fee is waived and costs $10.00.  If you are a senior citizen the cost is $10.00.

Credit to the buyer of unpaid real estate taxes -  Depending on how and when property taxes are billed in your county, it’s possible that you will have to credit the buyer 105% to 110% for real estate taxes that were for the time period you owned the home but will be billed after the closing date of the sale of your home.

Attorney’s fees
- If you choose to use an attorney (which you should by the way), you’ll either pay a flat fee starting around $375 or by the hour.  Your attorney will prepare the HUD-1 which ishome selling advice,selling advice,seller closing costs, the closing document that lists all closing costs/fees for both the buyer and the seller.  All or any of these fees will be added to your HUD-1 Statement for closing.

Broker’s commission - If you’re using a brokerage firm, expect to pay anywhere from 4 to 7 percent of the sales price.  Include any sales incentives that are popular now to attract more buyers to your home.

FHA fees and costs
- All FHA fees used to be the responsibility of the seller, but they are now negotiable. But if the buyer can’t pay the fees, and the seller refuses to kick in a few bucks, the lender may not fund the loan. There can be points based on the mortgage amount in which 1% is equal to 1 point of the loan amount.  Some areas also require a termite inspection which would be $75 to determine there is no termite infestation of your home.

- A building charge that can range from nothing to more than $400. Some cooperative buildings can charge a percentage of the sales price to permit the sale of the coop. In some instances these fees can be as much as three percent of the sales price.  In most instances it is a refundable fee that prevents damage to the common elements by either yourself or movers that are moving your belongings.

Association transfer fees
- Often required for condominium and townhouse sellers. Some of the fees are for processing the sales papers, move-out deposits, preparation of closing documents and even inspection fees.  Fees range from $75.00 to $200.00 depending on your association.

Paid utility bills
- In many areas, local municipalities will not let you close until you have proved that you are current on your water bill.  They will not issue your required transfer tax stamps without your paid water bill.

Certificate of compliance with building and zoning codes - Your local municipality may charge for inspecting your home prior to the sale to insure that it meets up to date code requirements. Such inspections can cost a nominal amount or run more than several hundred dollars plus the cost of fixing any items that are non-compliant. In addition, some municipalities charge a fee to verify the number of dwelling units permitted at a home being sold. The cost of such certificate can be nominal, but it may be a hassle to obtain the certificate.

Home Warranty
- Policy which guarantees to the buyer that all of the mechanical and electrical appliances are working on the day of closing and are guaranteed to work for the first year of ownership.  The cost for a warranty starts around $350 and can increase as additional option items are added.

Association reserves - In some areas, the reserves held by condominium or homeowner association are credited to the seller on the basis of the seller’s percentage of ownership in the association. Fortunately, for the seller, this is one of the few instances of money coming back to the seller rather than a payment by the seller.

Special assessments to associations
- In many associations, if a special assessment has been levied, even if it can be paid over many years, the association will require that the assessment be paid in full at the closing.

- In some cases, sellers give credits to the buyer for things that don’t work, or don’t look nice, in their home. For example, if the buyer’s inspector finds something wrong in the house, you may negotiate a credit to the buyer that will be paid at the closing. The cost of this will vary.

Unpaid mortgage or home equity loan or line of credit
- At closing, the seller must pay off any mortgage and home equity lines of credit that are relating to the home being sold. The seller must remember that the prior months’ statement for the mortgage will not include the interest that is owed on the loan from the last payment date. Almost all mortgages are paid in arrears: you pay last month’s interest in the current month. Therefore, if you made your most recent mortgage payments, you will still owe interest for the current month until the loan is paid off on the closing day.

Short Sale or ‘Upside Down’ Loans
- Although it seems unbelievable that anyone could be upside down on his or her mortgage (that is, owe more on the mortgage than the house is worth), many sellers each year will find themselves in this position. If you do manage to find a buyer, and the amount being paid for the home will not entirely pay off your mortgage, home equity loan or line of credit, you’ll have to come to the table with cash in hand. If the lender “forgives” your loan, the IRS may see that as income to you, and you’ll be taxed on the phantom income as if you actually earned it, at your marginal tax rate. Talk to your tax preparer for more details.

It’s important to keep a list of your closing costs, as well as a copy of all your purchase and sales documents, so that you can accurately figure out your home’s cost basis.

Understanding Agency or 'Who works for who' in a real estate transaction.

 

understanding agency, who works for who in a real estate transactionIt’s important to understand what legal responsibilities your real estate salesperson has to you and to other parties in the transaction.   Ask yourunderstanding agency, who works for who in a real estate transaction salesperson to explain what type of agency relationship you have with him or her and with the brokerage company.

 

Seller's representative (also known as a listing agent or seller's agent).  A seller's agent is hired by and represents the seller. All fiduciary duties are owed to the seller. The agency relationship usually is created by a listing contract.

Sub-agent
.  A sub-agent owes the same fiduciary duties to the agent's principal as the agent does. Sub-agency usually arises when a cooperating sales associate from another brokerage, who is not representing the buyer as a buyer’s representative or operating in a nonagency relationship, shows property to a buyer. In such a case, the sub-agent works with the buyer as a customer but owes fiduciary duties to the listing broker and the seller. Although a sub-agent cannot assist the buyer in any way that would be detrimental to the seller, a buyer-customer can expect to be treated honestly by the sub-agent. It is important that sub-agents fully explain their duties to buyers.  In Illinois, we do not practice sub-agency.

Buyer's representative or buyers' agent.   A real estate licensee who is hired by prospective buyers to represent them in a real estate transaction. The buyer's rep works in the buyer's best interest throughout the transaction and owes fiduciary duties to the buyer. The buyer can pay the licensee directly through a negotiated fee, or the buyer's rep may be paid by the seller or by a commission split with the listing broker.

Understanding agency, who works for who in a real estate transactionDisclosed dual agent.  Dual agency is a relationship in which the brokerage firm represents both the buyer and the seller in the same real estate transaction.  Dual agency relationships do not carry with them all of the traditional fiduciary duties to the clients. Instead, dual agents owe limited fiduciary duties. Because of the potential for conflicts of interest in a dual-agency relationship, it's vital that all parties give their informed consent.  In many states and in Illinois, this consent must be in writing.  Disclosed dual agency, in which both the buyer and the seller are told that the agent is representing both of them, is legal in most states.

Designated agent
(also called, among other things, appointed agency). This is a brokerage practice that allows the managing broker to designate which licensees in the brokerage will act as an agent of the seller and which will act as an agent of the buyer. Designated agency avoids the problem of creating a dual-agency relationship for licensees at the brokerage. The designated agents give their clients full representation, with all of the attendant fiduciary duties. The broker still has the responsibility of supervising both groups of licensees.

Non-agency relationship (called, among other things, a transaction broker or facilitator). Some states permit a real estate licensee to have a type of non-agency relationship with a consumer. These relationships vary considerably from state to state, both as to the duties owed to the consumer and the name used to describe them. Very generally, the duties owed to the consumer in a non-agency relationship are less than the complete, traditional fiduciary duties of an agency relationship.
